Jakarta, (Antarariau.com) - Top lawyer OC Kaligis has accused PT. Shimizu Corporation of Japan of having cheated his client, PT Dextam Contractor, to a tune of US$16 million.
"The fraudulent act of the Japanese companys top executive is against the law," he said here on Thursday.
Kaligis explained that his client had suffered a loss of around US$16 million because Shimizu had never clarified and had always covered up the ownership status of the fourth and fifth floor of a five-storey building of Mid Plaza II in Jakarta, often used as a shared office.
Shimizu Construction of Japan, which ran a construction business, came to Indonesia to seek a partner, which was well experienced, to enable it to gain access.
Shimizu met with a business partner, PT. Gotri Mega Tiara (GMT), to begin construction work and laid the foundation for a national construction capable of contributing to the Gross National Product (GNP).
Kaligis claimed that since 1973, the government of Indonesia had been providing opportunity to the Japanese construction company to cooperate with a local company.
Eventually, in 1974, Shimizu had agreed to cooperate by establishing PT Dextam Contractor, in which the composition of shares was 51 percent for Dextam and 49 percent for Shimizu.
Under this partnership scheme, Shimizu had recorded a speedy progress, but eventually split and formed a partnership with another company without notifying PT Dextam.
As a working partner, Shimizu alleged that the partnership was only a shield to obtain major projects. The executives of PT Dextam then filed a lawsuit against Shimizu.
In addition, Kaligis also reported to the police against Shimizu and booked a case at the Youngster, Children and Women (Renakta) Division of Jakarta Metropolitan Police, but the internal circle had actually made a research on the case and decided to issue an investigation discontinuation warrant (SP3).
In fact, Kaligis had also filed a lawsuit, No. 213/Pdt.G/Pn.Jkt.Pst, No. 214/Pdt.G/Pn.Jkt.Pst, and No. 215/Pdt.G/Pn.Jkt.Pst, against Shimizu; Bank of Tokyo, Mid Plaza II; and Jakarta Governor as a co-defendant.
Furthermore, Kaligis said Shimizu had left the responsibility of 49 percent stake, which is an unlawful act.
"As a matter of fact, Shimizu should have been involved in signing the document of the sale of PT Dextams asset in a bid to cover the companys losses," he said.
Meanwhile, when Shimizu Constructions lawyer Ahmad Irfan Arifin was contacted at his office in Jakarta, he said that for the time being his client could not provide information to the press.
"Sorry, a meeting will be conducted after which we will provide information on the accession concerned," replied Ahmad Irfan in the company of his partner Tagor Rikardo of the Lubis Santoso Maulana and Partner office.
